ALGEMENE VOORWAARDEN

1. ALGEMEEN Deze algemene voorwaarden zijn van toepassing op alle aanbiedingen, bestellingen en overeenkomsten van Apres Clothing, gevestigd te Graadt van Roggenstraat 6, 6522 AK, Nijmegen, Nederland, KvK-nummer: 98488716, BTW-nummer: NL868516892B01.

2. DEFINITIES

• Ondernemer: Apres Clothing
• Consument: De natuurlijke persoon die niet handelt in de uitoefening van beroep of bedrijf
• Webshop: www.apresclothing.nl
• Overeenkomst: De koopovereenkomst tussen ondernemer en consument

3. TOEPASSELIJKHEID Door een bestelling te plaatsen, gaat de consument akkoord met deze algemene voorwaarden. Deze voorwaarden zijn van toepassing op alle aanbiedingen en overeenkomsten, tenzij uitdrukkelijk schriftelijk anders is overeengekomen.

4. HET AANBOD

• Alle aanbiedingen zijn vrijblijvend, tenzij anders aangegeven
• Productbeschrijvingen en afbeeldingen zijn zo nauwkeurig mogelijk, maar kleine afwijkingen zijn mogelijk
• Prijzen zijn in euro's en inclusief BTW, tenzij anders vermeld
• Wij behouden ons het recht voor om prijzen en het assortiment te wijzigen

5. DE OVEREENKOMST

• De overeenkomst komt tot stand op het moment dat de consument de bestelling heeft geplaatst en wij deze hebben bevestigd
• Wij behouden ons het recht voor om bestellingen te weigeren of te annuleren
• Bij annulering van een bestelling door ons wordt de consument hiervan op de hoogte gesteld

6. HERROEPINGSRECHT (BEDENKTIJD)

• De consument heeft het recht om binnen 14 dagen zonder opgave van redenen de overeenkomst te ontbinden
• De bedenktijd gaat in op de dag na ontvangst van het product
• Tijdens de bedenktijd zal de consument zorgvuldig omgaan met het product en de verpakking
• Het product moet in nieuwstaat worden geretourneerd in de originele verpakking
• De kosten voor retourneren zijn voor rekening van de consument

7. UITSLUITINGEN HERROEPINGSRECHT Het herroepingsrecht is uitgesloten voor:

• Producten die zijn gemaakt volgens specificaties van de consument (op maat gemaakt)
• Verzegelde producten die om hygiënische redenen niet geschikt zijn om te worden teruggezonden (zoals ondergoed)

8. PRIJZEN EN BETALING

• Alle prijzen zijn in euro's en inclusief BTW
• Betaling dient te geschieden via de aangeboden betaalmethoden in de webshop
• Bij niet-tijdige betaling is de consument in verzuim en kunnen wij incassokosten in rekening brengen

9. LEVERING

• Levering vindt plaats op het door de consument opgegeven adres
• Levertijden zijn indicatief en geen fatale termijn
• Het risico van beschadiging en/of vermissing gaat over op de consument op het moment van levering
• Bij niet-levering door omstandigheden buiten onze macht zijn wij niet aansprakelijk

10. GARANTIE EN CONFORMITEIT

• Producten voldoen aan de gebruikelijke eisen en normen
• Bij gebreken die binnen 1 jaar na aankoop ontstaan, heeft de consument recht op herstel, vervanging of terugbetaling
• Garantie vervalt bij oneigenlijk gebruik of wijzigingen aan het product

11. KLACHTEN

• Klachten over geleverde producten moeten binnen 14 dagen na ontdekking schriftelijk worden gemeld
• Klachten worden binnen 14 dagen na ontvangst behandeld

12. AANSPRAKELIJKHEID

• Wij zijn alleen aansprakelijk voor directe schade die het gevolg is van een toerekenbare tekortkoming
• Aansprakelijkheid is beperkt tot het bedrag van de bestelling
• Wij zijn niet aansprakelijk voor indirecte schade, gevolgschade of gederfde winst

13. PERSOONSGEGEVENS

• Wij gaan zorgvuldig om met persoonsgegevens volgens de AVG
• Zie ons privacybeleid voor meer informatie over hoe wij omgaan met persoonsgegevens

14. INTELLECTUEEL EIGENDOM

• Alle intellectuele eigendomsrechten berusten bij Apres Clothing
• Het is niet toegestaan om content van de webshop te kopiëren zonder toestemming

15. TOEPASSELIJK RECHT EN GESCHILLEN

• Op deze voorwaarden is Nederlands recht van toepassing
• Geschillen worden voorgelegd aan de bevoegde rechter in Nederland
• Consument kan ook gebruik maken van de geschillencommissie

16. WIJZIGINGEN

• Wij behouden ons het recht voor deze voorwaarden te wijzigen
• Wijzigingen worden op de website gepubliceerd
• De meest recente versie is altijd van toepassing

TERMS AND CONDITIONS

1. GENERAL
These terms and conditions apply to all offers, orders and agreements of Apres Clothing, located at Graadt van Roggenstraat 6, 6522 AK, Nijmegen, The Netherlands, Chamber of Commerce number: 98488716, VAT number: NL868516892B01.

2. DEFINITIONS

• Entrepreneur: Apres Clothing
• Consumer: The natural person who does not act in the exercise of a profession or business
• Webshop: www.apresclothing.nl
• Agreement: The purchase agreement between entrepreneur and consumer

3. APPLICABILITY
By placing an order, the consumer agrees to these terms and conditions. These conditions apply to all offers and agreements, unless expressly agreed otherwise in writing.

4. THE OFFER

• All offers are non-binding, unless otherwise stated
• Product descriptions and images are as accurate as possible, but minor deviations are possible
• Prices are in euros and include VAT, unless otherwise stated
• We reserve the right to change prices and the range

5. THE AGREEMENT

• The agreement is concluded when the consumer has placed the order and we have confirmed it
• We reserve the right to refuse or cancel orders
• In case of cancellation of an order by us, the consumer will be notified

6. RIGHT OF WITHDRAWAL (COOLING-OFF PERIOD)

• The consumer has the right to cancel the agreement within 14 days without giving any reason
• The cooling-off period starts the day after receipt of the product
• During the cooling-off period, the consumer will handle the product and packaging with care
• The product must be returned in new condition in the original packaging
• The costs for returning are at the expense of the consumer

7. EXCLUSIONS RIGHT OF WITHDRAWAL
The right of withdrawal is excluded for:

• Products made according to consumer specifications (custom-made)
• Sealed products that are not suitable for return for hygienic reasons (such as underwear)

8. PRICES AND PAYMENT

• All prices are in euros and include VAT
• Payment must be made via the payment methods offered in the webshop
• In case of late payment, the consumer is in default and we may charge collection costs

9. DELIVERY

• Delivery takes place at the address specified by the consumer
• Delivery times are indicative and not a strict deadline
• The risk of damage and/or loss passes to the consumer at the time of delivery
• In case of non-delivery due to circumstances beyond our control, we are not liable

10. WARRANTY AND CONFORMITY

• Products meet the usual requirements and standards
• In case of defects that occur within 1 year after purchase, the consumer is entitled to repair, replacement or refund
• Warranty expires in case of improper use or modifications to the product

11. COMPLAINTS

• Complaints about delivered products must be reported in writing within 14 days of discovery
• Complaints will be handled within 14 days of receipt

12. LIABILITY

• We are only liable for direct damage resulting from an attributable shortcoming
• Liability is limited to the amount of the order
• We are not liable for indirect damage, consequential damage or loss of profit

13. PERSONAL DATA

• We handle personal data carefully in accordance with the GDPR
• See our privacy policy for more information on how we handle personal data

14. INTELLECTUAL PROPERTY

• All intellectual property rights belong to Apres Clothing
• It is not permitted to copy content from the webshop without permission

15. APPLICABLE LAW AND DISPUTES

• Dutch law applies to these conditions
• Disputes will be submitted to the competent court in the Netherlands
• Consumers can also use the disputes committee

16. CHANGES

• We reserve the right to change these conditions
• Changes will be published on the website
• The most recent version always applies
